Aceast\u0103 ordonan\u021b\u0103, publicat\u0103 \u00een seara zilei de 25 februarie, ar putea complica semnificativ tranzac\u021biile imobiliare \u0219i nu numai. Biri\u0219 \u00ee\u0219i exprim\u0103 \u00eengrijorarea cu privire la absen\u021ba unei perioade de tranzi\u021bie \u0219i ridic\u0103 \u00eentreb\u0103ri pertinente \u00een leg\u0103tur\u0103 cu actele autentificate \u00een aceea\u0219i zi, \u00eenainte de publicarea ordonan\u021bei.<\/p>\n<p>Conform lui Biri\u0219, acest act normativ, parte din \u201ePachetul 2\u201d \u0219i publicat \u00een Monitorul Oficial nr. 146\/25.02, impune o nou\u0103 cerin\u021b\u0103: la achizi\u021bia unui imobil, nu doar v\u00e2nz\u0103torul, ci \u0219i cump\u0103r\u0103torul este obligat s\u0103 prezinte un certificat de atestare fiscal\u0103. Acest certificat trebuie s\u0103 confirme c\u0103 toate obliga\u021biile c\u0103tre bugetul unei unit\u0103\u021bi administrativ-teritoriale au fost achitate, \u00een func\u021bie de domiciliul, sediul sau punctul de lucru al cump\u0103r\u0103torului.<\/p>\n<p>Biri\u0219 subliniaz\u0103 c\u0103, \u00een cazul nerespect\u0103rii acestei cerin\u021be, sanc\u021biunea prev\u0103zut\u0103 este <strong>\u201enulitatea absolut\u0103\u201d<\/strong>. \u00cen acest context, el ridic\u0103 o \u00eentrebare crucial\u0103: \u201eCe se \u00eent\u00e2mpl\u0103 cu actele autentificate ieri, \u00een timpul normal de lucru, av\u00e2nd \u00een vedere c\u0103 ordonan\u021ba a fost publicat\u0103 abia la 23:00?\u201d Biri\u0219 se \u00eentreab\u0103 dac\u0103 aceste acte trebuie resemnate \u0219i ce se va \u00eent\u00e2mpla dac\u0103 v\u00e2nz\u0103torul refuz\u0103 s\u0103 revin\u0103 la notar: <strong>\u201eR\u0103m\u00e2ne \u0219i cu proprietatea, \u0219i cu banii?\u201d<\/strong><\/p>\n<p>\u201eOK, dar ce facem cu actele autentificate ieri, \u00een timpul normal de lucru (s\u0103 zicem, p\u00e2n\u0103 la 18:00), dac\u0103 OUG a fost publicat\u0103 la 23:00? Trebuie resemnate? \u0218i dac\u0103 v\u00e2nz\u0103torul nu mai vrea s\u0103 vin\u0103 la notar? R\u0103m\u00e2ne \u0219i cu proprietatea \u0219i cu banii? Mergem \u00een instan\u021bele alea supra-aglomerate?\u201d, \u00ee\u0219i continu\u0103 Biri\u0219 tirada, eviden\u021biind confuzia generat\u0103 de aceast\u0103 schimbare legislativ\u0103.<\/p>\n<p>\u00cen postarea sa, Biri\u0219 ironizeaz\u0103 absen\u021ba unei m\u0103suri tranzitorii \u0219i critic\u0103 deciden\u021bii, suger\u00e2nd c\u0103 gestionarea acestei situa\u021bii ar fi putut fi realizat\u0103 mult mai eficient pentru a evita confuziile \u0219i eventualele blocaje \u00een practic\u0103.<\/p>\n<p><strong>Ce prevede ordonan\u021ba<\/strong><\/p>\n<p>Ordonan\u021ba de Urgen\u021b\u0103 nr. 7\/2026, publicat\u0103 \u00een Monitorul Oficial nr. 146\/25.02.2026, intr\u0103 \u00een vigoare imediat, cu c\u00e2teva excep\u021bii pentru anumite articole. \u00cen ceea ce prive\u0219te tranzac\u021biile de proprietate, ordonan\u021ba aduce modific\u0103ri semnificative \u00een ceea ce prive\u0219te certificatul de atestare fiscal\u0103:<\/p>\n<ul>\n<li>Pentru \u00eenstr\u0103inarea dreptului de proprietate (v\u00e2nzare), v\u00e2nz\u0103torii sunt obliga\u021bi s\u0103 prezinte un certificat fiscal care s\u0103 ateste plata obliga\u021biilor c\u0103tre bugetul local;<\/li>\n<li>Nou: pentru dob\u00e2ndirea propriet\u0103\u021bii (cump\u0103rare), \u0219i cump\u0103r\u0103torii trebuie s\u0103 prezinte un certificat de atestare fiscal\u0103 care s\u0103 dovedeasc\u0103 achitarea obliga\u021biilor c\u0103tre bugetul local al unit\u0103\u021bii administrativ-teritoriale unde au domiciliul, sediul sau punctul de lucru;<\/li>\n<li>Prezentarea certificatelor poate fi \u00eenlocuit\u0103 cu o verificare electronic\u0103 a situa\u021biei obliga\u021biilor fiscale;<\/li>\n<li>Actele \u00eencheiate f\u0103r\u0103 respectarea acestor cerin\u021be sunt considerate \u201enule de drept\u201d.<\/li>\n<\/ul>\n<p>De asemenea, ordonan\u021ba con\u021bine o prevedere care vizeaz\u0103 limitarea costurilor administrative, interzic\u00e2nd autorit\u0103\u021bilor locale s\u0103 impun\u0103 taxe locale sau taxe speciale pentru eliberarea certificatului de atestare fiscal\u0103.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gabriel Biri\u0219, cunoscut avocat \u0219i expert \u00een drept fiscal, a semnalat recent, printr-o postare pe Facebook, o modificare legislativ\u0103 important\u0103 introdus\u0103 prin Ordonan\u021ba de Urgen\u021b\u0103 nr. 7\/2026.
